FAIR FOR CONTRACTING FOOTWEAR, LEATHER GOODS AND CLOTHING
1. Exhibitors and products
1.1. We accept any products, services and documents related to sales, provided that they comply with the exhibition profile & theme and that they are indicated in the document accepted by the exhibiting party and approved by the organizer. The organizer reserves his right not to admit the exhibits that are not within the theme of the exhibition, as well as those that appear to be harmful and dangerous. The exhibitors are solely responsible for following the laws and regulations in Romania and internationally, and they considered to know in detail. Obtaining the permits required by law is the task of the exhibitors.
2. Registration – Participation
2.1. Exhibitor fulfills and signs two forms of the contract of adhesion. The two copies, completed, shall be returned to the organizer no later than 10 days prior to the event. After that we will accept adhesions only in the available space. Depending on the technical possibilities, the area allocated may differ from that applied for, or participation can be refused by the organizer. The organizer will specify in writing the allotted space and send the related invoice. If the exhibitor does not agree with the allotted space, he can cancel the participation by giving written notice to the organiser in 2 days of receipt of the notification by fax / e-mail. The lack of notification in the specified timeframe implies the tacit acceptance from the exhibitor. The organizer will fill the allotted space on the two copies of adhesion, it shall sign and send a copy of the exhibitor. From this moment, the application becomes a binding contract for both parties.
2.2. There are taken into account only those agreement applications which are signed, stamped and accompanied by the original copy of the registration certificate from the Trade Register.
2.3. The organizer may refuse the participation of the exhibitors who have not paid all payment obligations within the time limits specified in the bills. Exhibitors can use the allotted spaces only for the activity specified in the contract (prohibiting the en detail sales at the stands during the fair) and only if they have paid in full within the specified timeframe the payment obligations towards the Organizer.
If after concluding the contract and of the payment, the exhibitor cancels the participation after the registration deadline, the contract is terminated and the amounts paid are retained as a way of damages for moral and material prejudice caused in this way:
– In case of withdrawal within 15 days or less before the opening event, the amounts already paid by the exhibitor are fully retained;
4. Exhibition space
4.1. Allotted space / stand is available to exhibitors the day before the event’s opening, between 14.00 – 20.00 until the last day of the fair, 20.00. Exhibitor must free up the space in the final day, no later than at 20:00 and to give back the received stand in good condition.
Exhibitor undertakes to support any damage. Exhibitor agrees that, if the period for decommissioning exceeds 2 days, they will pay a penalty of the rent increased by 100% for the period exceeded. The Parties agree that, if the exhibitor did not pay all the amounts or caused other damage, the organizer has the right to retain its assets as collateral to recover damages.
4.2. The exhibitor may only use the allotted spaces. The use of sound (maximum permissible level: 65dB) and / or light that disturbs other exhibitors is forbidden. Exhibitor undertakes to respect copyright and other laws in the field, and is solely responsible.
All payments regarding participation in the exhibition shall be carried out within the time limits set in the invoices issued by the organizer only by bank transfer to the following account: RO07INGB0001008196228910 or cash (according to the regulations in force). Bank charges should be attributed to the exhibitor.
6.1. During installation of the exhibitor stands timeframe, in the previous day of staring the fair (in accordance with article 4.1.), exhibitor staff will be allowed access between 9:00-20:00; stand removal can be done starting at 13:00 on the last day of the fair.
Access during the event is:
Exhibitors: 9.00-18.30, and the last day between 9.00-20.00.
The visitors’ program for the 3 days of the fair is between 10.00-18.00, and the last day 10.00-14.00.
Exhibitors are obliged to comply with the exhibition schedule.
6.2. Vehicles exhibitors have access only in specially designated parking based on parking. During the exhibition, vehicle access is allowed close to the exhibition space between 18.00-18.30.
6.3. The exhibitor is obliged to sign for receiving the allotted spaces and to complete construction / stand arrangement until 20:00 the day before the event. Otherwise, the organizer will consider that the exhibitor has canceled the participation and the space will be allotted to another exhibitor.
6.4. Exhibitors undertakes to comply with the exhibition schedule and not leave space before closing event. Failure to following the schedule of the event forces the exhibitor to pay a 10% penalty on the amount of space rental invoice.
The exhibitor has the right to advertise his products only within his own stand. Distribution of leaflets and samples outside the stands may only be made with the prior approval of the organizer.
The advertisement shall be in accordance with commercial principles and laws of Romania. The organizer has the right to remove without exhibitor’s approval, the advertisements and other publicity materials within and outside his own stand, where deemed not in accordance with Romanian law, with the conditions for participation or which disturb other exhibitors.
8. Ensuring security; Liability
8.1. The organizer provides general security of the exhibition building exterior / outdoor space outside the schedule of the fair (art. 7), without being held responsible for the security of goods and materials of the exhibitors. Property insurance is recommended. In the case of disappearance of an exhibit / object of the stand, the exhibitor must immediately report this to the Police. The exhibitor is responsible for the security, integrity and safety of its goods during the program, according to paragraph 6.
8.2. The exhibitor is fully responsible for observing the legal fire prevention (including pledges to take all measures to limit and strict supervision smoking stand and territory allocated specifically for smoking), the rules of labor protection and for damage caused Hotel / organizer, visitors or other exhibitors, under the Civil Code.
8.3. For reasons of force majeure, the organizer may cancel the event or can alter the period and / or location of deployment. The organizer will inform exhibitors within 5 days from the occurrence of force majeure.
8.4. The organizer reserves the right to change the time and / or location of the exhibition and pavilions allocated after the announcement prior to exhibitors with less than 60 days before the opening of the event, without the exhibitor being able to claim damages.
9.1. Any litigation or dispute shall be settled by the two parties amicably within 3 working days of the first attempt at settlement.
9.2. Disputes unresolved amicably, arising out of or in connection with this contract will be subject to the Court of International Commercial Arbitration attached to the Chamber of Commerce and Industry of Romania, applying the Rules of Arbitration of the Chamber, the Roman law and the provisions this contract. The arbitral tribunal shall consist of three arbitrators, one appointed by each party and the third – presiding arbitrator – appointed by the two arbitrators. The parties undertake to execute the court’s decision is final and binding.
These Participation Conditions are supplemented by the General Conditions of fairs and exhibitions and are part of the adhesion contract.
